Under Section 18 of the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2019, a worker is entitled to 7 days of casual leave with wages and 7 days of leave on medical grounds with wages in every calendar year, both credited at the start of the year and lapsing if unused. A valid medical certificate is required to support sick leave taken for more than two consecutive days. Separately, earned leave accrues at one day for every 20 days worked once 240 days of service in a year is completed, and the Act provides for 8 paid festival holidays a year (including Republic Day, Independence Day, and Gandhi Jayanti). A doctor-issued medical certificate is the standard supporting document Gujarat employers expect when sick leave is availed under this Act.
Employees covered under the Employees' State Insurance (ESI) Act at establishments within the scheme's reach can additionally claim ESI sickness benefit, administered separately by ESIC.
