What the Rajasthan Shops and Commercial Establishments Act, 1958 actually guarantees — and how to get a doctor-verified certificate to support it.
Rajasthan Shops and Commercial Establishments Act, 1958
Unlike most other states' Shops Acts, the Rajasthan Shops and Commercial Establishments Act, 1958 does not set out a separate statutory sick-leave or casual-leave entitlement. Chapter IV, Section 14 of the Act provides only for annual (earned) leave with wages: an employee who has worked 240 days or more in a calendar year is entitled, in the following year, to leave calculated at one day for every 12 days worked (one day for every 15 days for a child worker) — a more generous earned-leave accrual rate than the one-day-per-20-days used in several neighbouring states. Because there's no dedicated statutory sick-leave bucket, medical absence in Rajasthan is typically governed by an individual employer's own leave policy rather than the Act itself, which makes clear, doctor-issued documentation especially useful for getting medical absence recognised and paid consistently.
Employees covered under the ESI Act can separately claim ESI sickness benefit regardless of the Shops Act's leave categories, administered by ESIC.
